Accused On Bail Has No Right To Seek Permission To Travel Abroad: High Court

  • Justice Subhash Vidyarthi delivered the verdict while dismissing a plea filed by Aditya Murti, a consultant at the Shri Ram Murti Smarak Institute of Medical Sciences, Bareilly.

The Allahabad High Court has ruled that an accused person who is out on bail does not have the inherent right to seek permission to travel abroad. This decision came in response to a petition by an accused in a money laundering case who sought to travel to the UAE for business. The court emphasized that granting such permission is at the discretion of the trial court, which must consider the nature and gravity of the offense, the accused's role, potential flight risk, and the impact on the investigation or trial. The court also noted that the accused's right to travel abroad is subject to reasonable restrictions, and in this case, the trial court's refusal to allow travel was deemed justified.
